Legal Concerns Raised in El-Rufai's Cybercrime Charges

Human rights lawyer Iniebeh Effiong has expressed concerns about the legal validity of the cybercrime charges filed against former Kaduna State Governor Nasir El-Rufai. The charges allege that El-Rufai unlawfully intercepted phone communications related to national security, as indicated in a Facebook post by Nuhu Ribadu.

Effiong highlighted flaws in the charge sheet, particularly noting that the Department of State Services (DSS) lacks prosecutorial power, which raises questions about the authority of the prosecution. He emphasized the need for the prosecution to exercise due diligence and amend the charges if necessary.

Effiong clarified that his concerns are not politically motivated but are focused on adherence to proper legal procedures in Nigeria. He recalled that several cases have been dismissed due to weak prosecutorial foundations, criticizing the prosecuting agencies for their lack of diligence.

Effiong hopes that his concerns will prompt a review by the relevant authorities.
