Appeal Court Dismisses NBC's Fine Imposition Suit

The Media Rights Agenda (MRA) achieved a significant legal victory when the Appeal Court in Abuja dismissed the National Broadcasting Commission's (NBC) appeal seeking to overturn a Federal High Court judgment. This judgment, delivered by Justice James Omotosho on May 10, 2023, had prohibited the NBC from imposing fines on broadcast stations, which the commission had attempted to levy against 45 stations for alleged breaches of the Nigeria Broadcast Code.

The NBC's appeal was unanimously dismissed by the court on November 23, 2023. The commission had previously sought to set aside the ruling that invalidated the fines, which were initially announced on March 1, 2019.

The MRA's legal challenge arose after the NBC imposed a fine of N5 million on a television station in 2022 for allegedly undermining Nigeria's national security. The court's decision reinforces the legal framework surrounding the imposition of sanctions for criminal offenses in Nigeria.
