Nigeria Wins $6.2M Arbitration Case Against European Firm

Nigeria has won a $6.2 million arbitration claim against European Dynam UK Ltd, as ruled by the Bureau of Public Procurement (BPP). The arbitration, overseen by Mr.

Funmi Robert, dismissed the contractor's claims in their entirety, relieving Nigeria of potential financial exposure. The legal team, led by Johnson Wilner LLP and Nigerian business technology law firm Basil Udotai, Esq., argued that the contractor's claims, which included approximately $2.4 million for milestone completion and $3 million in general damages, were unfounded.

The BPP, under the directorship of Dr. Adebowale Adedokun, identified significant deficiencies in the contractor's performance, which fell within the vendor's responsibility to remedy without additional costs.

The tribunal found no evidence of BPP's consent to merge contract phases and concluded that the claims were not valid. Attorney General Lateef Fagbemi, SAN, praised the outcome as a significant signal for public sector technology contracts in Nigeria.
