AAC Sues Tinubu for Not Transferring Power to Shettima

The African Action Congress (AAC) has initiated legal action against President Bola Tinubu for his failure to hand over power to Vice President Kashim Shettima while on vacation in Europe. The suit, filed on September 28, 2026, in Abuja by Inibehe Effiong, the AAC's National Legal Adviser, names Tinubu, Attorney General of the Federation Lateef Fagbemi SAN, Senate President Godswill Akpabio, Speaker Tajudeen Abass, and the National Assembly as defendants.

The case, marked FHC/ABJ/CS/2353/2026, argues that Tinubu's lack of a written declaration to the Senate President and House Speaker violates Section 145(1) of the 1999 Constitution. The AAC contends that the National Assembly acted unconstitutionally by not passing a resolution for Shettima to assume acting presidential powers after Tinubu's absence exceeded 21 days.

The party is also seeking a perpetual injunction against future presidents from vacationing without adhering to constitutional handover provisions. The affidavit states that Tinubu left Nigeria on vacation on August 30, 2026, and extended it on September 21, 2026, without providing reasons.
