APC Challenges Court Order for Tinubu's Service in 2026

The All Progressives Congress (APC) has challenged a Federal High Court order that permitted former Vice President Atiku Abubakar and the African Democratic Congress (ADC) to serve President Bola Tinubu with court documents through the APC. The APC contended that this order was unnecessary since Tinubu's legal team had already obtained the originating processes, filed a preliminary objection, and submitted his defense prior to the order for substituted service being granted.

This position was outlined in a letter dated September 22, 2026, addressed to the Deputy Chief Registrar of the Federal High Court in Abuja. Justice Inyang Ekwo had granted the order on September 16 after the plaintiffs claimed they could not serve Tinubu personally.

The APC stated that it learned of the order through media reports and had not received an enrolled copy. The suit, filed in August, named Tinubu, the APC, and the Independent National Electoral Commission as defendants.

The APC expressed surprise at the plaintiffs' actions, given that Tinubu's legal representation had already accepted service on his behalf.
