Atiku's Legal Challenge Against Tinubu's Candidacy

Former Vice President Atiku Abubakar filed a suit on August 14, 2026, at the Federal High Court in Abuja, seeking to disqualify President Bola Ahmed Tinubu from the 2027 presidential race. The suit, filed alongside the African Democratic Congress, targets Tinubu, the All Progressives Congress, and the Independent National Electoral Commission, alleging that the NYSC discharge certificate submitted by Tinubu contains a name that differs from his own.

Legal analyst Ekene Aninze noted that Atiku's filing was within the 14-day window mandated by Section 285(9) of the 1999 Constitution for pre-election matters, as INEC displayed candidates' particulars on August 1, 2026. However, Aninze pointed out that the suit's format, filed as an Originating Summons, may expose it to legal challenges, as Nigerian courts have ruled that forgery allegations require a Writ of Summons for proper resolution, allowing for oral testimony and cross-examination.

This principle is supported by previous Supreme Court rulings regarding similar disputes.
