Court Orders Dana Airline to Pay N5.5m for Flight Delay

The Federal High Court in Lagos has ruled in favor of lawyer Babajide Idowu, awarding him N5.5 million in damages and legal costs against Dana Airline Limited for a flight delay that occurred on July 5, 2018. The judgment, delivered by Justice Y.

Bogoro on May 26, 2026, was made public in Abuja. Idowu's legal representative, Lekan Ikuomola of Ayodeji, Babajide and Lekan Partners, filed a writ of summons in November 2019, claiming that Dana Airline breached the Contract of Carriage by failing to transport Idowu's client on time, resulting in a delay of approximately 12 hours.

Justice Bogoro noted that the airline did not deny the delay and emphasized that a contractual relationship exists once a ticket is purchased. The judge cited the Civil Aviation Act, 2006, stating that the airline must fulfill its obligations.

He found no evidence that the airline had taken necessary measures to avoid the delay and ordered Dana Airline to pay N5 million in damages and N500,000 in solicitor’s fees.
