Ubani Advocates for Clear INEC Guidelines on Elections

Ubani, SAN, has called for the Independent National Electoral Commission (INEC) to clearly define what constitutes "communication failure" and to establish guidelines for electronic transmission of election results. His recommendations come as part of the ongoing discussions surrounding the Electoral Amendment Bill 2026, which is currently awaiting presidential assent.

Ubani identified three major provisions related to electronic transmission: mandatory electronic transmission of results, statutory recognition of the INEC Results Viewing (IReV) portal, and a fallback form (EC8A) in case of communication failure. He emphasized that the proposed framework should ensure that results are recorded and uploaded immediately after polling, with the presence of party agents and security personnel to prevent delays.

Ubani noted concerns regarding the potential for manipulation due to the fallback clause and highlighted the importance of voter education and technological literacy among agents. He urged for the agreement on the bill to become law ahead of the 2027 general elections to enhance transparency and public confidence in the electoral process.
