NERC Transfers Electricity Oversight to Akwa Ibom Commission

The Nigerian Electricity Regulatory Commission (NERC) has officially transferred regulatory oversight of the electricity market in Akwa Ibom State to the Akwa Ibom State Electricity Regulatory Commission (AKSERC). This transfer aligns with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023.

Under the provisions of the Electricity Act 2023, NERC retains regulatory authority over inter-state and international electricity operations. States intending to regulate their intrastate electricity markets must notify NERC and request the transfer of authority.

Following this transfer, NERC has instructed Port Harcourt Electricity Distribution Plc (PHEDC) to create a subsidiary named PHEDC SubCo, responsible for intrastate electricity supply and distribution in Akwa Ibom State. PHEDC is mandated to complete the incorporation of this subsidiary within 60 days from August 18, 2026, and the subsidiary must obtain a license from AKSERC to operate.

All transfers under this order are to be finalized by February 17, 2027, as part of Nigeria's decentralized electricity market framework.
