Court Declares Local Governments Autonomous for Education Funds

On October 13, 2025, Justice Emeka Nwite of the Federal High Court in Abuja ruled that local government areas (LGAs) in Nigeria are autonomous entities under the constitution. This landmark decision allows LGAs to access federal education funds directly from the Universal Basic Education Commission (UBEC) without needing state government intermediaries.

The ruling struck down provisions of the UBEC Act that previously restricted LGAs' access to these funds, which have been significantly trapped, with reports indicating that over N250 billion remains unspent. The court's decision is a response to the long-standing issue of inadequate funding for basic education, exacerbated by states' failure to provide counterpart funding.

The ruling is expected to enhance the delivery of primary education and social infrastructure at the local level. However, the judgment may face appeals from 37 State Universal Basic Education Boards (SUBEB), and the implementation of this ruling may encounter challenges due to governors' opposition to direct funding for LGAs.
