Supreme Court Rules on WAEC's Federal Agency Status

On June 13, 2025, the Supreme Court of Nigeria addressed the jurisdictional status of the West African Examinations Council (WAEC) in a case involving Mohan Lawal and others. The plaintiffs had worked for WAEC for fourteen years and sought pension benefits after their employment was terminated.

The trial court initially dismissed their claims, leading to an appeal. The Court of Appeal found merit in the appeal, ruling that WAEC unlawfully denied the plaintiffs their pension entitlements.

However, the Supreme Court identified jurisdictional issues, stating that the Federal High Court lacked the authority to hear the case as it involved a federal agency. The court emphasized that the matter should be transferred to the National Industrial Court, which has the appropriate jurisdiction to handle employment-related disputes.
