AAC Files Suit Against Tinubu for Vacation Protocol Violation

The African Action Congress (AAC) has filed a lawsuit against President Bola Tinubu, the National Assembly, and the Attorney-General of the Federation in the Federal High Court in Abuja. The suit, filed on a Monday, alleges that Tinubu failed to transmit a written declaration to the National Assembly before leaving Nigeria for Europe on August 30.

The AAC claims this action breaches Section 145(1) of the 1999 Constitution, which requires the President to notify the Senate President and the Speaker of the House of Representatives in writing before proceeding on vacation. The case, marked FHC/ABJ/CS/2358/2026, names Tinubu, Attorney-General of the Federation, Senate President Godswill Akpabio, Speaker of the House of Representatives Abbas Tajudeen, and the National Assembly as defendants.

The AAC seeks a declaration that the failure to transmit the declaration was undemocratic and unconstitutional, along with a ruling on the National Assembly's alleged failure to act after Tinubu's absence exceeded 21 days. The party also requests an injunction preventing future vacations without proper notification.

The case was filed by Inibehe Effiong of Inibehe Effiong Chambers, and no hearing date has been set.
