Giwa Challenges APC Primary Election Outcome in Court

Barrister Victor Giwa has approached the Federal High Court in Abuja to nullify the outcome of the All Progressives Congress (APC) primary election for the Esan South Constituency seat in the Edo State House of Assembly. The suit, filed on May 29, 2026, under case number ABJ/FHC/CS/1078/26, seeks a court order to restrain Chief Sundai Oseizua Ojiezel from being declared the winner of the primary election and to prevent him from being recognized as the APC candidate for the 2027 elections.

Giwa's lawyer, Mr. Patrick Ocheja Okolo SAN, argues that the primary election was conducted irregularly, and that the APC and the Independent National Electoral Commission (INEC) should be joined as respondents.

The suit requests that the court maintain the status quo pending the determination of the substantive suit, emphasizing that the primary was neither conducted nor adopted as a consensus arrangement by the APC.
