Lagos Court Sentences Benedict Agara to Death for Murder

On Thursday, a Lagos State High Court in Ikeja, presided over by Justice Modup Nicol, sentenced 35-year-old Benedict Agara to death by hanging for the murder of Amina during a dispute on April 3, 2021, at Jakand Housing Estate. The prosecution, led by Titilayo Olanrewaju and Daud Z.

Abdulaziz, established that Agara inflicted multiple stab wounds on Amina using a broken bottle. The court noted that the prosecution successfully proved the essential elements of the offense beyond a reasonable doubt.

Justice Nicol emphasized that the burden of proof remained with the prosecution throughout the trial. Although no eyewitness directly saw Agara stab Amina, the circumstantial evidence presented was deemed overwhelming.

The court dismissed the defense's arguments regarding the admissibility of a confession statement made by Agara, ruling it inadmissible due to the absence of legal representation during its recording. The judgment concluded that Agara's unlawful actions directly caused Amina's death.
