Lawyer Sues Air Peace Over Business-Class Upgrade Policy

Dr. Adesanya has instituted a suit against Air Peace at the Federal High Court in Lagos, challenging the airline's business-class upgrade policy, which he describes as unlawful.

The case, marked FHC/L/CS/364/2026, raises issues of consumer protection and passenger rights within Nigeria's aviation sector. Adesanya claims he paid for a business-class upgrade for a flight from London to Lagos but received economy-class services, including meals.

He alleges that Air Peace failed to disclose the limitations of the upgrade policy prior to payment and did not reflect these terms in their published conditions. The airline's counsel, Chief Oluwol Afolabi, filed a preliminary objection to strike the suit, arguing that the matter involves factual disputes requiring oral evidence.

However, Adesanya's counter-argument maintains that there are no substantial factual disputes necessitating such evidence. The court is expected to first determine the preliminary objections before addressing the substantive issues raised in the suit.
