Gumi Advocates for Women's Rights in Abusive Marriages

On Monday in Kaduna, Sheikh Ahmad Gumi, an Islamic cleric, asserted that no woman should endure an abusive, harmful, or toxic marriage according to Islamic law. He explained that Sharia offers several lawful options for women to exit such marriages, including mutual consent divorce, khul‘, judicial annulment, and delegated divorce.

Gumi elaborated on mutual consent divorce, which allows spouses to amicably end their marriage, and khul‘, where a woman can initiate divorce by returning her dower. He noted that judicial annulment, or faskh, permits a woman to seek dissolution without returning her dower under valid grounds, such as abuse or abandonment.

Gumi also mentioned delegated divorce, where a husband can transfer divorce authority to his wife. He emphasized the importance of arbitration and mediation before divorce and expressed concern over the challenges faced by Sharia courts in Nigeria, including corruption and limited legal awareness among women, which can trap them in abusive marriages.
