Expert Calls for PIA Amendments to Align with Constitution

Queen Amina Moham has raised concerns regarding the Petroleum Industry Act (PIA), urging for amendments to align it with the 1999 Constitution to prevent potential legal conflicts in Nigeria's petroleum governance framework. Although the PIA represents a significant reform in the oil and gas sector, Moham argues that its provisions do not fully comply with constitutional requirements concerning revenue remittance.

She highlights that the PIA allows the Nigerian National Petroleum Corporation (NNPC) to limit the retention of petroleum revenue, which could conflict with Section 162 of the Constitution mandating federal revenue to be paid into the federal account. Moham emphasizes the need for legislative action to ensure compliance and proper allocation of funds, warning that the current structure may sidestep constitutional revenue-sharing mechanisms.

She also points out the quasi-commercial role of the NUPRC, which could blur the lines between regulatory oversight and commercial interests. Moham concludes that while executive orders may provide temporary solutions, permanent amendments to the PIA are necessary for constitutional harmonization.
